We at the DrugDev group (DrugDev, Inc., along with its subsidiaries) respect your concerns about privacy. You can navigate much of our website without giving us any personal information about yourself. However, sometimes we need additional information about you in order to provide the information or services you are requesting. This privacy policy covers the personal information collected through this website and the similar information obtained in other ways (excepting our other websites) where we control the personal information collected.  This policy sets out what information is collected, how we use that information, who that personal information is shared with, and your rights regarding your personal information. This policy also includes our approach to your personal information when our clients control the processing.

This website is hosted by DrugDev Inc. subject to the Terms of Use of this website.

1. Collection of your personal information

1.1 On this website

This website allows you to create an account and to enter a range of personal information such as your name, location, institution, therapeutic speciality, contact information, studies and research interests, plus documents that contain personal information, such as CVs and GCP certificates, the key uses of which are described in section 2.1 below.

We collect additional personal information about you through the use of cookies (defined in section 2.2 below), web beacons (as also defined below) and other automated means when you use this website. This information will be collected by DrugDev Inc. for the general uses described in section 2.2 below, however certain of this information, namely the dates and times on which you create, access or change your account, will also be used as set out in section 2.1 below.

Registration with and use of this website is on a purely voluntary basis.

1.2 In other ways

As part of our business facilitating the clinical trial process, we collect a similar range of personal information to that collected on this website but in other ways. These ways include web searches, or being sent such information directly from you or through referrals.  Other websites of ours may collect personal information but these are governed by their own policies.

We also collect personal information that is controlled by clients, such collection being either directly from them or on their behalf.  The scope of information and how it is collected is governed by the agreement between the relevant client and us. You should review the privacy policies of these companies to the extent that they collected personal data from you.

2. Key uses of your personal information

We acquire, hold, use, and process personal information based on the legal grounds and for the legitimate business purposes outlined in this policy or as otherwise clearly identified at point of collection.   The personal information we collect about you is used in the following key ways:

2.1 By DrugDev Ltd

Where the personal information is not controlled by our clients, it will be available to DrugDev Limited, a UK subsidiary of DrugDev Inc, which may in turn make such information available to its clients which are involved in pharmaceutical trials (such as pharmaceutical companies, contract research organizations and clinical research associates) or to its affiliates so that they may make such information available to their respective clients which are involved in pharmaceutical trials.

Such entities may use your personal information to:

  • Create and manage your account
  • Invite you to participate in a clinical trial
  • Identify and assess trial sites and investigators for clinical trials
  • Reach out to you with surveys, clinical trial feasibilities, or site pre-qualification services
  • Respond to and communicate with you about your requests, questions and comments
  • Contact you about new products and offerings, product and services improvements, product and services discounts, educational industry events, surveys, feedback on potential clinical studies and ascertaining your interest in participating in clinical studies
  • Protect against, identify and prevent fraud and other criminal activity, claims and other liabilities
  • Comply with and enforce applicable legal requirements, relevant industry standards and our policies.

Information you provide during the completion of a clinical trial feasibility survey can be stored in order that when an identical question is asked in a future survey your answer will be pre-populated, with the aim of saving you time on completing the survey.   Opportunity is provided for you to edit your response if required.  If you do not wish this to be the case please contact privacy@drugdev.com

2.2 By DrugDev Inc. as the host of this website

DrugDev Inc. collects certain information by automated means on the website. The information we collect in this manner includes IP address, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our site, and dates and times of website visits. Cookies are small pieces of information that are stored by your browser on your computer’s hard drive. DrugDev Inc. uses cookies to identify registered users without needing to ask for registration details every time you access the website. DrugDev Inc. may also use cookies to track registered or unregistered users as they travel through the site, for instance the total number of unique users who are accessing the site over a particular period of time. 2.3 For our clients

We use personal information that is controlled by clients.  The scope of the use is governed by the agreement between the relevant client and us, and, where applicable, through your agreement with our client and its privacy policies.

2.4 Other uses

To create anonymous and/or aggregated information: we may use Personal Information and other information about you to create anonymized and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our services, or other analyses we create. Anonymized and aggregated information is used for a variety of functions, including the measurement of visitors’ interest in and use of various portions or features of the services. Anonymized or aggregated information is not personal information, and we may use such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. We may share this information within the DrugDev group and with third parties for our or their purposes in an anonymized or aggregated form that is designed to prevent anyone from identifying you.

3. Do we share your information?

We may share your Personal Information as described in this policy (e.g., with our third-party service providers; to comply with legal obligations; to protect and defend our rights and property) or with your permission.

The DrugDev group will not sell, trade, rent or otherwise pass on your personal information to others, except as described in this privacy policy or with your prior consent.

The DrugDev group reserves the right to transfer personal information about you in the event of the sale or transfer all or a portion of their business or assets (including in the event of a reorganization, dissolution or liquidation).

The DrugDev group may share personal information with service providers who perform functions and services on their behalf. Such third parties are provided with personal information necessary to perform the services but are not authorised to use such information for any other purposes.

The DrugDev group may disclose personal information about you (i) if required to do so by law or pursuant to legal process, (ii) in response to a request from law enforcement authorities or other government official, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.

The DrugDev group may also share anonymous statistics for research or market development purposes. For example, what percentage of registered users of this website have a primary interest in oncology.

We do not share personally identifiable information with unrelated third parties who are not covered by this privacy statement without your prior permission, except to the extent reasonably necessary to: (i) correct technical problems and malfunctions; (ii) protect the security and integrity of our website; (iii) protect our rights, interests and property and the rights, interests and property of others; (iv) comply with laws or to respond to judicial process; or (v) provide information to law enforcement agencies or for an investigation of a matter as applicable, or otherwise as required or permitted by law.

4. Data transfers

This website is hosted by DrugDev Inc. in the U.S.A.

As the DrugDev group is an international group of companies with clients in countries around the world, your data could be transferred internationally throughout our worldwide organization and to our service providers or agents, including for hosting our databases or provisions of data processing services, in accordance with applicable data privacy laws. When we transfer your information to other countries, we will protect that information as described in this privacy policy.

DrugDev may also share personal information as described in this policy herein above, and you should consider the possibility of this sharing to happen with international entities.

DrugDev may transfer Personal Information for specified, limited purposes, to an Agent and will endeavor to obtain assurances that such Agent provides at least the same level of privacy protection as is required by the Privacy Shield Principles (where applicable) and this Policy and will notify DrugDev if it makes a determination it can no longer meet this obligation.

Where DrugDev knows that any third party to whom it has provided Personal Information is using or disclosing Personal Information in a manner contrary to this Policy, DrugDev will take reasonable steps to prevent or stop the use or disclosure. With respect to such onward transfers to Agents, and to the extent DrugDev is responsible for the event, DrugDev shall remain liable should its Agents process Personal Information in a manner inconsistent with the Privacy Shield Principles (where applicable) and this Policy.

To demonstrate our commitment to the protection of Personal Information, including Personal Information transferred out of the European Economic Area (“EEA”) and Switzerland for the performance of our services and business operations, we adhere to the Privacy Shield Principles and are certified to the EU-U.S. Privacy Shield Framework (“Privacy Shield”), as set forth by the U.S. Department of Commerce and the Federal Trade Commission. We also use model contractual clauses and other mechanisms approved by the European Union and Switzerland, respectively, for transfers of Personal Information from the EEA and Switzerland.

5. Your rights

You may view, update, amend or correct your personal information that you register on the website at any time via the “Member Login”. You may also ask us to remove your personal information that is collected on the website by contacting us at privacy@drugdev.com.

You may request that the DrugDev group cease sending you marketing communications, whether by email or otherwise. You can do this by contacting privacy@drugdev.com. Please note that it can take up to 10 days for the opt-out to take effect and communications may be sent to you in the intervening time.

You may request access to your personal information where the DrugDev group controls such information, and update, amend or correct the information. You may also object to the use of your personal information. If you would like to make a complaint or submit an inquiry, please contact privacy@drugdev.com.

In circumstances in which the DrugDev group obtained or maintains your personal information as a service provider for any client, such client controls the handling of such information.  The relevant member of the DrugDev group will provide reasonable assistance to you where you have queries or complaints.

6. How we protect personal information

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Unfortunately, the internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

By using the website or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the website. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the website or sending an e-mail to you. You may have a legal right to receive this notice in writing.

Where the personal information is not controlled by clients, we take reasonable steps to permanently and irrevocably anonymize or otherwise delete the personal information you provide once it is no longer necessary to maintain the information in an identifiable form in order to fulfil a business purpose or other lawful requirement.

Our website may contain links to other websites for your convenience and information. These websites may be operated by companies not affiliated with the DrugDev group. Linked websites may have their own privacy policies or notices, which we strongly suggest you review if you visit any linked websites. We are not responsible for the content of any websites that are not affiliated with the DrugDev group, any use of those websites, or the privacy practices of those websites.  Note that other websites of ours are governed by their own policies.

8. Children’s privacy

This website is not directed to children under the age of thirteen and we do not knowingly collect personal information from children under the age of thirteen on the website. If we become aware that we have inadvertently received personal information from a visitor under the age of thirteen on the website, we will delete the information from our records.

9. Changes to this Privacy Policy

This privacy policy may be amended from time to time and all changes will be posted here. Where the changes are significant, registered users may also receive an email with the new privacy policy.
